There is a justification process that goes on in the consumers mind when it comes to these collection agencies.
“I owe what I owe to (Sears, Macy, Visa, Chase, HFC, etc) the creditor”

“I am responsible and I will pay what I owe”

“I need to pay the creditor but I am not going to pay the collector”

“How can I not pay the original creditor when I owe them money”

First of all, if the consumer cannot pay these days, there is most likely a hardship situation…….. unemployment, medical emergency, divorce, death. We should not have overextended ourselves in credit anyway (but we are about to change that for the future) and we have learned a big lesson. We had great credit scores and bills were current. Then the unexpected happens. Bad goes to worse and the collection agencies want money.

Here is the justification. It is a paradigm shift. Plus we have the FDCPA and the FCRA on the consumers side.

The OC has a balance sheet and they have profit and loss. Credit card holders who cannot pay are on the balance sheet as a loss. The OC takes a “charge off” and puts it on your credit report. They get a tax break as a business from this charge off. Then there is the IRS who gives them so much loss as a huge corporation. THEN the OC sells the worthless paper to JDBs for pennies. The OC made a profit from you and have been paid by you – the consumer – and it is business as usual.

Now the collection agency (JDB) has a list with name, number and balance on a spreadsheet. They have not paid for the balance of the account. So what gives them the right to collect the balance when they DO NOT OWN the balance. There is no balance for the OC so why is there a balance for the collection agency. The collection agencies tell the consumer that they were assigned to collect for the OC. Not true. The debt collector is counting on the consumer ignorance that we do not know what the rights are when it comes to “assignment” of an alleged debt.

The objective of the JDB / collection agencies is to get you to pay them. Instant profit for them. Do you take their word for it that you owe them money? They want you to set up payment arrangements, send in a post dated check, make a settlement for a discount on the balance, or pay in full. They are bullies trying to take your lunch money at recess – remember those types? Did you know that you can sue the collection agency?

DO NOT PAY!

Once you pay them and they receive payment – you are acknowledging that you do owe them money. It is almost impossible to fight them and dispute it once they receive your payment but it can be done.

This can be overwhelming dealing with collection agencies. Do not procrastinate and ignore them. They need to prove the alleged debt to the consumer on paper. Contact us for a free consultation to see if we can make these collectors go away forever.

Collection debt elimination in 60 days without settlement

When Next Level Credit uses the word elimination in regards to collection debt, it means eliminate immediately without paying the collection agencies.

Eliminate immediately. How soon is “immediately”?

No payment schedule, no settlement, no post dated checks mailed, no checking account draft.

Gone in 60 days (give or take another 30) forever.

The FDCPA states that the debt collector has to PROVE the alleged debt and send the consumer validation. The collection agencies cannot prove (in most cases) that they own the alleged debt, therefore, the consumer DOES NOT PAY the debt collection agency.

The reason Next Level Credit sends correspondence to the debt collector is to have the collection agencies validate the alleged debt. For example, the consumer receives a letter/phone call from the debt collector, Next Level Credit corresponds with the debt collector on behalf of our client. In a matter of months, the account is eliminated and the collector ceases to collect ANY money at all. Each client has their own particular situation and we work with our client hand in hand.

The word elimination is thrown around alot when it comes to current debt and current credit card balances. It usually means that over time on a payment schedule the debt can be eliminated. This is true in most cases. Debt elimination is a broad term and can be understood that it requires a payment plan to pay off the debt. We do not advocate debt consolidation at all.

Debt collection elimination is a totally different world. In the collection debt world, elimination takes 30-90 days.

Almost every day, we talk to a consumer who is intimidated by the debt collection letters and phone calls. The knowledge of fighting the debt collectors is in front of us but why isn’t it shared freely? Is there a conspiracy to keep consumers in the dark when it comes to collection debt elimination? YES!

The finance experts tell you to consolidate your collection debt and pay it off. The debt collector will tell you that they were “assigned” to collect. Ask them for proof. The debt collector will tell you they have the rights from the credit card company of the original creditor. Ask them for proof.

The finance experts will not tell you that you have rights as a consumer to challenge the collection debt. The consumer advocates tell you to negotiate with the collection agencies. The label “consumer advocate” can be misleading. Do they really have the consumers best interest or are they being pc because of who they are and the toes they may step on?

Sometimes people come into your life and you know right away that they were meant to be there. To serve some sort of purpose, teach you a lesson or help figure out who you are or who you want to become. You never know who these people may be but when you lock eyes with them, you know that very moment that they will affect your life in some profound way. Sometimes things happen to you at the time that may seem horrible, painful and unfair, but in reflection you realize that without overcoming those obstacles you would have never realized your potential, strength, will power or heart. Everything happens for a reason. Nothing happens by chance or by means of good luck. Illness, injury, love, lost moments of true greatness and sheer stupidity all occur to test the limits of your soul. Without these small tests, life would be like a smoothly paved, straight, flat road to nowhere. Safe and comfortable but dull and utterly pointless. The people you meet affect your life. The successes and downfalls that you experience can create who you are, and the bad experiences can be learned from. In fact, they are probably the most poignant and important ones. If someone hurts you, betrays you or breaks your heart, forgive them because they have helped you learn about trust and the importance of being cautious to whom you open your heart. Tell yourself you are a great individual and believe in yourself, for if you don’t believe in yourself, no one else will believe in you.

Shout out to our readers who have told us Mann Bracken and Fredrick Hanna are exposed. Big exposure with the government.

This is wonderful news for many consumers! This is victory! You made it happen!

Here is an interesting tidbit: A friend who was hired at Mann Bracken was told they were a law firm. She was an administrative assisant in their office. Two weeks after being hired, they approached her about a change in job duties. She was given a script and told to call customers to ask for payment. Needless to say, she knew about debt collectors and some of their tactics. She saw money flowing like water thousands per week. Bonus’ money to reward the productive employees. They had to make a quota. She was not “hired” to do that and she left the company. Her very descriptive statement to us was that “Mann Bracken is ruthless”.

No doubt. But not for much longer.

When a consumer receives a debt collection letter in the mail, read the letter and take action. The action that needs to be taken is to write a letter to validate the debt.

First of all, how old is the debt? If the debt is at least seven years old, then you would write a SOL statute of limitations letter and send it certified mail return receipt. Some JDB send letters on debts (paid debts too) 10 years old. Where do you find the SOL letter? HERE ON THIS SITE. Copy, paste and tweak it for your scenario.

No matter how old the collection debt may be, the consumer needs to write to the debt collector. If you do not write, the situation may become worse and there may be a lawsuit. At least by writing a letter, the consumer will have documentation sent to the debt collector.

Within 30-60 days the consumer will have results. 99% of the debt collectors in the USA cannot validate the alleged debt.

Our question to the consumer: Do you understand why you are allowed to write to the debt collector? Do you understand why the debt collector has to respond? Do you understand the FDCPA and the FCRA?

If you have any collection debt and any negative items on your credit report you NEED to know the laws/acts. It is for your own protection.
