We know that we have been posting many articles about Mann Bracken and Hanna. They are in the headlines/news right now. And we have more news – good news for consumers – in Georgia. This news applies to consumers all over the country not just in Georgia where the Hanna office is located.
We have an update on Frederick J. Hanna. Thanks to consumers being active and tenacious, there is change. The NUMBER ONE COMPLAINT to the FTC in 2008 was about the debt collection industry. Consumers complain that a Marietta debt collection firm uses deceit and abusive tactics to collect money, even when it isn’t owed, records show.
Enough complained that the Georgia Governor’s Office of Consumer Affairs began investigating last fall. It ordered Frederick J. Hanna & Associates to answer questions about collection practices, consumer disputes and what it does to ensure the validity of debts.
But for three months the state’s top consumer watchdog agency and the debt collector have been in a standoff.
Frederick J. Hanna & Associates says its tactics are none of the state agency’s business. Because it’s a law firm, the debt collector contends it is outside the consumer office’s jurisdiction. It refuses to answer the agency’s questions.
“We don’t feel like they’re entitled to anything. Period,” Frederick Hanna said. He said his firm gets 50,000 new debt files each month and its collection methods are legitimate.
The consumer office says it has a right to investigate whether the firm’s tactics are breaking state law. “If we perceive an infraction of the law, we don’t believe your status as a law firm will protect you,” said Bill Cloud, a spokesman for the consumer office.
A hearing is scheduled March 30 in Cobb County Superior Court and the outcome could have a significant impact on thousands of Georgia consumers targeted by debt collectors — especially those who don’t owe money.
Here and across the nation, consumers complained more about debt collectors than any other industry in 2008, according to new data from the Federal Trade Commission’s Consumer Sentinel Network.
The network, used by law enforcement, tracks complaints to the FTC, as well as to groups such as the Better Business Bureau, FBI, U.S. Postal Inspection Service, Social Security Administration and the National Consumers League.
Last month the FTC issued a report saying the debt collection legal system needs reform and the 1977 Fair Debt Collection Practices Act needs to be modernized to reflect changes in technology, debt and the collection industry.
While the FTC said timely payment of debts is important, it said the law needs changes to better ensure that collectors are going after the right people for the right amounts of money. The law also needs to mandate that collectors give consumers better information about their legal rights.
Complaints about debt collectors are on the rise and some of the tactics firms use are already illegal, Cloud said.
“A lot of them are buying up ‘zombie debt.’ It’s old debt you cannot collect anymore by normal means,” Cloud said. “It’s essentially debt renewal. To get you back on the hook they try to intimidate and try to berate you.”
Zombie debt, like the name implies, is debt — legitimate or not — that refuses to die. It may be debt that resulted from identity theft years ago that the original creditor wrote off. It may be a legitimate debt that is several years old, was already paid off or has been legally erased by bankruptcy. The debt gains new life when sold to a collection agency for pennies on the dollar.
In November, the state consumer office served an investigative demand notice, similar to a subpoena, on Frederick J. Hanna & Associates. It asked for documents about the firm’s collection practices, including those involving zombie debts. Officials with the consumer office declined to give details about the complaints they have received about the firm, citing the ongoing investigation.
The firm has an “F” rating with the BBB because of its complaint history, including failing to respond to consumer concerns, according to BBB records.
State officials are investigating potential violations of Georgia’s Fair Business Practices Act, according to the notice, including allegations the firm engaged in abusive or oppressive tactics prohibited under state and federal laws and allegations the firm used misleading and deceptive methods. The notice does not provide details or examples.
Hanna said Friday that if the consumer office wants to review a few specific files, he’d allow it. But he said he has hundreds of thousands of files and it is unreasonable to provide them all, as has been requested.
Until recently, it was unclear whether the state Fair Business Practices Act could be applied to debt collectors. In 2007, the Georgia Court of Appeals held that collection of a debt is a consumer transaction covered by the law.
Frederick J. Hanna & Associates, in documents filed in Cobb County Superior Court, says the consumer office is asking for an unreasonable amount of information. But beyond that, the debt collection law firm contends that the consumer office has no jurisdiction over the practice of law and therefore no jurisdiction over its activities. The consumer office is seeking an order from the court to force the firm to comply with its demand for documents and information.
State consumer officials have opened a similar investigation of Mann Bracken, a national debt collection law firm with an office in Atlanta. Mann Bracken also contends the consumer office doesn’t have jurisdiction, according to Fulton County court records. Lawyer conduct is regulated only by the State Bar and the Supreme Court of Georgia, the firm said in documents filed in court.
Hanna said Spotlight should not be focusing on debt collection firms. The problem is the debtors and the amount they owe, he said, adding that consumers should try to work with people like him.
Cloud warned that consumers should be careful about anything they say to a debt collector. Insist the firm send you written proof you owe the money, he said.
“If this is an old debt and you do not believe you owe this money, do not in any way, shape or form reaffirm this debt,” Cloud said. “They are probably recording you.”

Recently this Hanna group stole Social Security deposits from a relatives Bank of America
account in Fitzgerald, Ga. This is against Federal law, but they did it anyway & will not return said Social Security monies. These people are retired, their only income & cannot file bankruptcy, nor can they afford an attorney to pursue return of that which was taken
by these crooks at Hanna. I feel sure this Hanna bunch has done this to many others & have gotten away with it over & over……..knowing it is illegal!

Hannah & Assoc. just had a garnishment put on my bank account, which is funded by SS disability and civil service disability pension. They have taken all the funds I have, my rent, utility bills, etc. I pay bills from my account and there were several due to be paid. When they were submitted to the bank, they were rejected causing me excessive charges. They are rude and ruthless in their collection tactics. The amount they have garnished for is an unsecure credit card that is approx. 4 years old. I have tried to explain to them that freezing my account involves federally protected funds, but they say they can do what they want; I owe the money.
I totally agree that Hanna is one of the most corrupt collection agencies. They put a freeze on my bank account with no notice and took my SS disability leaving me with nothing to live on. I informed them to the fact that SS is protected by Federal law and they didn’t care. This was done for an old account that they have not even submitted proof that it is a valid debt. I can’t understand how it is legal to do such a thing without giving a person a chance to respond before securing the only income one has.
These hoodlums called me amd told me that I had two hours to give them or they would proceed with a lawsuit. They were very rude and demanded that without the money they cound not work with me. Thay sent me an unsigned letter in which I responded with a request for validation letter.

I have had an episode with these blood suckers as well. I left on maternity leave and was not paid for 3 months and therefore used plastic money (Chase) to pay off some bills. I did not buy a big screen or stereo or anything else that I could sell to get this money back, I paid off bills while I was out of work with my daughter. They contacted me and threatened legal action if I did not settle this right away they would take me to court or garnish my wages. The man I spoke with gave me false promises “what if I could do $200/mo” I said sure, he put the manager on and she says $360, I said what happened to $200? She said oh well he can’t quote that, we can’t do it, I said neither can I! After they did get my account information and whacked me 3 months in a row, screwing up my account and me ending up with overdraft fees I cancelled the account. They STILL got money out of my NEW account through my old card because it was set up with both accounts for a short time until I got my new card. They told me on the phone we “can’t post date debit card payments” yet thats exactly what they did. I told him he made his money and leave me alone or do what you have to do. I’m glad I’m not alone with this battle.

Thanks for your comment. We question the draft out of your account and how it was authorized. Stop all verbal contact on the phone and send Hanna a VOD letter immediately. Talk to your bank about the recourse you have about your money and you may have to contact an attorney about the money taken out of your account as another plan to recover those funds.

Just received an unsigned letter from Hanna. What is a “VOD letter”? I am working with a debt negeotiator/settlement firm on the account, and they have a poa letter. Every available money(1100/mo.)we haveis going to one other creditor, and will be Jan 2010 before that one is paid off. What do I do here?

Thanks for your comment. A VOD letter is a letter to request validation of debt. Since you have received a letter from Hanna, you will need to send a VOD letter to Hanna immediately.

For the last two weeks, I have received calls for “Billy Black.” Despite my cooperating with the Hanna people — SEVEN TIMES — they refuse to remove my telephone number from their mailing list. I have had my number for six years. I have never heard of Billy Black. Yet, Mr. Hanna’s rude people keep calling. Last Friday, they called in the afternoon, and I gave my explanation — again. I got the promise that they would not call — again. Ten minutes later, I got another call from the same number [404-525-3470]. No one spoke. I heard only laughter — female. The ladies were whooping it up. When I got home from work today, there was another call waiting for me. I returned the call and followed the directions, asking to speak to Miss Wilson. She told me to hold on, while she contacted someone else who would take care of my request. Then the phone went dead.
Miss Wilson should be ashamed. If Mr. Frederick J. Hanna actually has a law degree, he should be reported to the Georgia Bar Association’s Judiciary Board.

I received a phone call from these people today. I answered they hung up. I called them back, spent forever on the phone being jockeyed around until finally getting a chance to leave a voice-mail.
Then a woman called me back. WOW! Rude from the start. She demanded my Social Security number. I informed her that no I will not give her that over the phone. She then proceeded to say she was going to refer my case to court proceedings because I am refusing to cooperate. I was shocked and asked what the bill was for or an amount. She said she had no way of knowing because they had 2000 (my name)’s in the database.
She then asked me for my birth-date and DL # . I was upset and informed her that I have already been the victim of identity theft and will not give any of that over the phone. She started getting loud and telling me I was breaking the law they are going to now sue me for refusal to cooperate,etc etc.
I shot back that she was the one doing so and if they continued to harass or threaten me I will call my attorney, to cease and desist all harassment. I told her to send me a paper bill in the mail and I will pay it but thats it.
I am perfectly willing to pay a bill if I have overlooked it, but this is insane. A debt collector who calls to collect but doesn’t know what they are collecting or for who? How could this be? Then to threaten me for not giving out personal information over the phone? These people are stepping over the line here.

I have been a victim of Frederick J Hanna & Associates. I am being sued by this company over a debt that I am not responsible for. My purse was stolen 10 years ago and i reported my credit card stolen. Someone used my credit card and when I talked to them they canceled the card and I thought it was resolved. I was not notified by the credit card company that I was is in debt due to someone using my stolen credit card. This year i received a letter from Frederick J Hanna about this debt and they threatened to garnish my check if I didn’t pay half of the total which is $1700. I pleaded with them to allow me to pay $700, and they denied. They said they would garnish my check if I didn’t pay the whole $1700. They never contacted through the mail about this debt. I thought this was settled ten years ago when I contacted Archer Bank. But I had to pay $1700 and I am two months behind on my mortgage due to this. I have to pay $173 a month and if not, they will garnish my check. This company had gotten over on so many people and they have to be stopped!

Thanks for your comment. The only way a consumer can be garnished is through a judgment. Do you have a judgment? Were you EVER served a summons? If so, did you file an Answer?
You need to fight back with this – the “debt” is not yours, plus THEY have to prove it – even if you go to court.

I have been trying to work with Frederick J Hanna for over a year now. They served me with papers last year and I got them to drop all charges. I have paperwork from United Healthcare showing where they paid the hospital for when I got my wreak. I have sent this paperwork to Frederick J Hanna multiple times but they keep saying that they need to talk to the hospital before they can do anything. They’ve promised to call me multiple times but never do. I’ve called multiple times even leaving voicemails saying I’m willing to work with you but I need the right amount so that I can set up a payment plan and I want to get this done with so it will no longer be over my head. When I do get a hold of someone they insist I have to pay the full amount, they’ve also lost all my paperwork and I’ve been switched to another case worker…again. They apologize about me “slipping through the cracks”…again. Yesterday they served me with papers…again. The thing is I wasn’t even at the house, the papers got dropped off to my mom. Is that legal? I have called multiple times today and keep being sent to voicemails. What should I do?

about 2 years ago, my fiance owed Hanna for an unpaid credit card bill. without any warning they put a freeze on his bank account, which lead to 4 checks bouncing. tried to garnish his wages but he was able to contact them which resulted in having to deal with a very rude woman….I took money out of my retirement 401k and we sent a certified check to Hanna…in the mean time someone in their mailroom got the check and cashed it. They claimed they never got the money. Thank God it was a certified check and the bank covered it. We haven’t heard from them for 2 years, now all of a sudden they are requesting copies of our mortgage payments, and car payments. This company is crooked, deceitful and have thieves working in their mailroom. When I saw the envelope in the mail today from Hanna, I started trembling. I have owed past debts before, but the collection agencies always were cooperative and allowed me to make monthly payments. What in the world is wrong with this Collection agency!!!! thanks for letting me vent
Yesterday a sheriff showed up at my door saying that I need to contact Fredrick Hanna about a debt that was owed to a credit card company. First of all, I have not had an account with this company for over 11 years. The sheriff gave me a case number (how do you get a case number when you have never been to court) and told me if I don’t contact Hanna they will be back with a FIFA and take things out of my home. This was the oddest moment, the sheriff would not give me any paperwork and I signed nothing acknowledging that we even spoke. She informed me to get a pen and write the information down. I am at a complete loss on how to proceed with the situation. If anyone can give me some guidance on how to research this “case” without having to hire an attorney I would appreciate your help.

#2 IF NOT, you could have gotten this vacated – you may still be able to on grounds of improper service. Are you in GA?
You paid without proof of judgment? But someone else cashed it – did you send them more money !!! Stop doing that.

Sounds like the statute of limitations will apply with this but hard to fight in court.
You usually get a case number that is filed with the county with lawsuits. Are you in GA?
DO NOT CALL HANNA!!!!! The cop is supposed to give you the SUMMONS.
