The case was DISMISSED. It was very interesting for me to be in the middle of this courtroom with all the unsuspecting consumers and a Hanna collection attorney. I wanted to strangle this man yet pray for him at the same time. Does he realize what he is doing? And when the Fredrick J Hanna ship goes down that attorney is going down with it.
Last night, I had the opportunity to go to court on a Hanna lawsuit. The good news about the suit was the Plaintiff named WAS a debt collector. As the CA called out the cases, possibly 10, he stated that he wanted to meet with each defendant out in the hallway. I was very confident about this case but I was not too sure the defendant (my friend) was as confident. The defendant had a lawyer which sent Hanna very powerful affirmative defenses and interrogatories the week before, however, Hanna did not respond. My friend (without his lawyer) was prepared to come against this CA with prepared points. Preponderance. Rules of Evidence. This was an education for me.
FEAR OF THE UNKNOWN IS AWFUL!
As the 10 defendants went out with the CA, we waited in the courtroom. Long story short, the CA came back in, went in front of the judge regarding my friends case ”your honor we prayerfully request dismissal”.
I almost missed it. It was so fast. And I am so transparent that I almost did the touchdown sign “arms up” yeah we won! But I kept calm and cool. My eyebrows did go up and I did smile for a split second. I was so relieved it was over and the defendant did not have to say a word!!!
Be encouraged. This can happen with any collection attorney. Even pro se. Use the DEFENDANTS PACKAGE to file an answer to the court.

My pay be garnished starting on April 20 , 2012. I am unsure on how they can do this when I never recieved anything in the mail.

Thanks for your comment. Call your court clerk. Check if you have a judgment. That is the only way you can be garnished. If you were never served, you may be able to vacate.

They started garnishing my wages again after I paid them off in 2012, I was never informed on why they were trying to get more money out of me. I was never even served the proper paperwork, and I have records from the first garnishment. I called Frederick J Hanna law office and practically went off on him. I told things I would do about stopping the garnishment, he was like who told you to do that. My response was I know how to research information, to make a long story short, they stopped the garnishment. Now I’m wondering if there’s anything I could do about this from looking at the original letter they sent me back in 2008, the signature I have on the letter by Dennis Henry it’s not even his handwriting come to find out.
I paid them off in 2010 instead 2012.

Thanks for your comment. Hanna does not have any rules. Garnishment is done without warning most of the time.
There is not enough info here in your comment…you have a judgment and you paid them in full? Anything you can do about what?
