When a consumer is dealing with a junk debt buyer sometimes the consumer may think they are losing their mind.
The debt collector wants to confuse the consumer to have the consumer doubt themselves.
Here is a list of examples:
1. you paid off a credit card balance years ago but the collection agency says otherwise telling you it is collections unpaid
2. you receive a letter and it is not your identity but because your name is on the piece of paper it must be yours
3. you receive a letter from a collector with the original creditors logo and vp signature stamped on it – is it from the OC or from a collection attorney
Let’s expound on #3 . . .
Would it make sense to believe if you see letterhead and logo of American Express it would be from Amex? Modern technology these days and just a jpg and a banner can create any company letterhead. You say “well that is against the law to impersonate/imply the letter is from American Express”. We say these people break laws all the time to get you to pay them. Mitchell N Kay office offers a $25 American Express gift card. They want your money. Who cares about a gift card? It is confusing to the consumer to get a letter from a collector with the Amex letterhead. This guy wants to confuse you. They want you to call with confusion.
This agency is aligned with Plaza Associates and they work side by side to collect money from unsuspecting consumers. You may get letters from the law office or Plaza Associates.
Send a VOD (validation of debt) letter to them as soon as possible. Do not talk on the phone to these offices. There is no point to talking on the phone and the best protection is correspondence.

I’ve had dealings with Mitchell Kay and AMEX. Send them a cease telephone communications and a validation and dispute, they’ll go away in short order. Mitchell Kay is in his 70’s – 80’s and probably doesn’t even go into the office anymore (rubberstamp threats)….
Just got a letter from this bogus law firm stating they are collecting for their client, Asset Acceptance, for an alleged debt on an account held and closed (paid in full) about twenty years ago.
If this was just the Mitchell N. Kay office, I’d just laugh and toss the letter, but the “Asset Acceptance” part is a bit bothersome. Those guys are serious thugs and can create a lot of headaches for people. I’m shocked they’re still in business. They’ve brazenly violated so many laws so often and so consistently, I really have to wonder who’s in bed with whom that they haven’t been shut down once and for all.
Wrote a very long, clear and strongly worded DV letter to both Asset and Kay, covering all the nasty tricks these vermin are likely to use, CCed the FTC, AGs of my state, Michigan, and New York, the Postal Inspector and a complaint about the Kay practice to the NY Bar Association. I spoke with the FBI (they advised me to file a complaint with the USPS for Mail Fraud), and while they couldn’t really do anything yet, they took all the information down for future use if necessary.
Hope that works. These guys are ramping up activity big time in light of these dire economic times. I suspect they’re going after people such as my husband and myself who have no debt at all because they can see via our credit reports that we have zero credit card balance, pay all our credit cards in full each month, and have no debt at all besides what’s left on our mortgage. I suppose they hope we’ll think it’s an account we’ve forgotten (we’re not quite that senile yet, thankyouverymuch) or we’ll be so afraid we’ll pay up to make them go away.
It’s a sad, sad world we live in…sad how the courts we pay for can be used against us by lowlifes such as this, sad that states allow them to remain in business because they bring in state revenue and employ people, sad that the BBB gives them all outstanding ratings merely because they pay the BBB to be accredited and because the BBB considers a “response” to be the same as “resolution”.

Yes it is very sad that the courts do not recognize corrupt behavior at this point in time in this economy.

The Law Offices of Mitchell N. Kay of New York, NY, left a message with my husband on 07/07/09 for me to call them at 800-420-9132 x5238. I googled them and found out they were a scam collection agency. I then ordered my credit report from Experian and it came back perfect. On 07/09/09 I received a call from them again and the man told me they were calling about the $17,000 I owed Capital One. I told the man I never had a Capital One account and that I had a copy of my credit report. He told me social security numbers don’t lie and hung up on me. Then I called Capital One and spoke with with Roy Marquec, ID# TFI, of the Capital One Fraud Division (800-427-9428), where Mr. Marquec confirmed that I have never had any accounts with Capitol One. Mr. Marquec checked both my social security number and my name and address to see if there was any record of an account with them and found no accounts. This law office has been known to freeze bank accounts. I have reported them to the NYS Attorney General (where they are already under investigation), to the FTC, and to the NYS Bar Association. I have also contacted my state senator and congresswoman.

Thank you for your comment. We are almost shocked about this type of behavior with Mitchell N Kay. It is not unusual however for junk debt buyers to attempt to collect on a fabricated account.
If you can get any further information from them, we suggest that you write to them EVEN though it is not your debt. This is to protect yourself for any further collection attempts with MNK. You may want to send MNK an original notarized document from Mr Marquec. Also if you reside in NY this is an issue to be on your guard.

I googled Mitchell N Kay cause I’ve been getting messages from them about a debt and came across this message board. The crazy thing is they are using my name from a previous marriage. I’ve been divorced for 12 years and haven’t gone by my name since then and even then was only married for 2 years so there was only a short period of my life when I went by that name, and I’m positive that I don’t have any debt under that name. I did check my credit reports and all 3 are clear. So how do I make them go away?

Write a VOD letter to MNKay regardless of the married name or not. Basically you are challenging them to prove it.

Thanks for your comment. Phone calls are not so much a threat. Plaza needs to send a letter to you first. Then you need to ask for VOD.
