Canton resident Frances Glasgow filed suit against Michael J. Scott PC in Carrollton on Jan. 4 in the Eastern District of Texas, Tyler Division.

Honolulu attorney Marvin Dang runs what is believed to be the largest debt-collection law firm in the state, filing more than half of the 21,000 collection lawsuits in Hawaii’s district courts in fiscal year 2010.

Dang’s firm represents Hawaii financial institutions, banks, credit unions and loan companies and also major credit card issuers, such as Capitol One, American Express and Citibank.WE SERIOUSLY QUESTION

His firm, which has a VERY UNORGANIZED staff of about 50, including five lawyers, filed about 11,000 cases in fiscal year 2010 and 6,000 in fiscal year 2009, most of them for credit card cases, Dang said.

Dang, a state representative from 1982 to 1984, said the reason lenders and institutions turn to him is that his firm tries to resolve the cases before filing a suit, which would add a filing fee and other fees to the amount sought.

His staff will send letters to delinquent credit card customers and make phone calls to see whether they can resolve the (JUNK) debt, Dang said.

“It’s not the mentality of some of the other law firms, where they get the case and they sue. Our approach is to try to work things out before we sue,” he said.

Dang suggests that the number of lawsuits is a function of the economy rather than his clients becoming more aggressive in recovering on debts or the availability of credit cards.

“I don’t get a sense that they’re more willing to have cases go to suit,” he said.

“If anything, the clients are getting a little bit more flexible in terms of what they’re willing to settle for,” he said.

Dang said financial institutions and credit card companies have been more restrictive in offering credit in recent years, similar to the scrutiny for potential mortgage borrowers.

“I don’t think it’s necessarily a function that there’s been wide availability of credit cards because things have really tightened up over the past few years,” he said.

He suggests that if anyone is notified about a debt or is sued, they should talk to the creditor, the bank, the lender or the lawyer.

“There’s always a good possibility that something can be worked out positively,” he said.

Even if the offer from the debtor seems too low, his firm notifies the client and “sometimes they accept it,” Dang said.

“You’d be surprised at the number of cases in which we were able to work things out,” he said. SCARE CONSUMERS INTO PAYING

Since we have not dealt with Marauder, here are a few facts from Bud Hibbs site: Criminal debt collector and serial FDCPA violator Ryon Alan Gambill has the dubious distinction of being one of the worst and one of the dumbest debt collectors in the United States.

Gambill hides behind Kim Nicole Edwards, his most recent wife, with his home on Goleta Avenue in Palm Desert, California. He has amassed an estimated

$3.5 million in unpaid judgments by default – judgments filed for violating debt-collection law. That makes him one of the biggest DEAD BEAT debt collectors in the nation.

Ryon Gambill is a perfect example of why we need federal legislation to police abuse of the credit bureau reporting system. His use of Experian’s databases is nothing more than an act of extortion.

Sadly and outrageously, Experian knows all too well about Gambill’s criminal history, yet it turns a blind eye and a deaf ear to consumers’ complaints.

Experian reportedly denied the existence of his company representative who quit after learning his name was published on several Web sites.

He shamelessly impersonates lawyers, police, the FBI, and anyone else, depending what the situation necessitates. He has stolen money from his clients and the American people – and then lied about it on top of that. He is without a doubt, the scummiest of the scum-feeding bottom dwellers of the debt-collection industry. The End.

United Recovery Systems office is in Houston, Texas. This CA is busy mailing letters and calling consumers. Their bark is worse than their bite. This agency was established in 1977 and usually is not able to validate the alleged debt of the consumer. This collection harassment is incessant calls rather than letters.

We have read that a few years back, it is very difficult to work there and the collectors who call the consumers are harassed themselves on the job. It was stated that this collection agency has no scruples and that the employees have questionable backgrounds and financial problems. Is that a surprise???

If you receive a letter from this company BEWARE because they may be aligned with the Law Office of James A West in Texas who is known to sue consumers.

We do not write about lawsuits and judgments because we focus on what the consumer can do to challenge the collection agency harassment and POSSIBLY avoid being sued. The collection harassment includes dunning notices and phone calls. Have debt collection lawsuits have increased in the courts and are the courts being used as a mere extension of a collection agency?
 
According to November 29, 2010 Wall Street Journal: The biggest explosion in lawsuits is coming NOT from the lenders but from firms who buy debt. The four largest publicly traded debt buyers – Encore, Asta Funding, Asset Acceptance Capital Corp. and Portfolio Recovery Associates – purchased $19.6 billion in distressed debt last year. They typically recover THREE TIMES what they spend buying (worthless) debt, according to the Association of Credit and Collection Professionals, a trade group. Our emphasis in red.
 
If this is not enough to have consumers shout a little louder to their Attorney General in their state to crack down on collection agencies – then what is? PURE PROFIT collections from a debt that is worthless! This industry has become more aggressive in the past six months since the last six months when we noticed the change.

Stop Collection Agency Harassment from LVNV Funding

We have this dialogue over and over again with consumers>>> Please understand >>> The consumer receives a collection letter otherwise called a dunning letter and believes that they should pay the collection. Understandably so. However, just because it looks legit, does not mean it IS legit.

“Why would you want to pay a collection agency who did not pay YOUR BALANCE of the original account to the original creditor?” And the consumer states “Well the collection agency states it was ASSIGNED to them” NO IT WAS NOT ASSIGNED.

In other words, do not pay any collection agency any money that they do not legally have a right to collect. Read the FDCPA and the rights for the consumer regarding collection agency harassment (yes when they are sending multiple letters and calls).

LVNV Funding is a decent sized collection agency in South Carolina that has been in business for many years. This CA is all over ripoffreport website. They are a major junk debt buyer tied in with Sherman Acquisitions and other smaller collection agencies Alegis, Resurgent and Ventus. However, you do have to stop debt collectors no matter what size they appear to be.

 

If a consumer is served a summons/complaint, and the plaintiff is named LVNV Funding, is should be apparent that the collection ATTORNEY that is listed on the summons is indeed collecting for their busines. In other words, LVNV Funding is not suing the defendant, but the collection attorney is suing and keeping all the $$$$$$$. Note: if the plaintiff named is the original creditor…here is a hint…original creditors do not sue. The collection attorney is suing the defendant and keeping all the $$$$$$.

How can that be? It just is until YOU the consumer make enough noise to your Attorney General and have that business investigated.

GC Services is known for attepting to collect on AMEX accounts. Does GC Services buy the AMEX accounts or do they have a cozy relationship with American Express? Can GCS validate the alleged account?
 
 

Not to be confused with GC Services in Texas, Global Credit & Collections in New York is another collection agency that is in the “top 300 worst” debt collectors in the US. That reputation becomes each of them because of the compliants to the FTC and the AG in the state. We wonder how long Global Credit and Collections will survive in NY due to the fact that the NY AG is very busy shutting down collection agency harassment. He does stop debt collectors. Both of these collection agencies call incessantly and send automated letters consistently.

Stop Collection Agency Harassment from Client Services Inc

Client Services Inc is known for bombardment of calls and letters to the consumer which is collection agency harassment. When Client Services Inc is challenged by the consumer about the alleged account, the CA stops the calls and letters. Their bark is worse than their bite. This CA office attempts to collect on thousands and thousands of alleged accounts. Volume is key to this junk debt buyer.

The consumer should NOT pay Client Services Inc. CSI does not validate alleged accounts. Some consumers who do not understand the corruption of JDBs will start paying a CA and then be trapped into an endless situation with no resolution. Paying the CA does NOT help your credit score.

Atlantic Credit & Finance are not a credit and finance company. Their name is very misleading. The employees are known for threatening lawsuits and garnishments. They can threaten and sue quickly due to the “relationship” with John P Frye Law Office. However, they lose in court IF the consumer knows what to do about the Answer.
 
John P Frye Law Office location is in Roanoke, VA. The Woolwine brothers are cousins of John P Frye. Kellie Carter of John P Frye and Chris Perdue of Atlantic Credit & Finance are cozy working together. She works with Chris at ACF. What does she do? She handles phone complaints from consumers.

The good news is last year (2009) both companies were laying off employees. How can we say that is GREAT NEWS about people out of work??? Most of their employees don’t even understand the corruption of ACF and John P Frye and think they are a legitimate collection agency working on commission. The employees are better off NOT to work there. If the employee works for a CA, they are desperate!!! This is illegal practices. ACF buys junk debt for .09 cents on the dollar – reported in Dec 2008.
